Who we are

This website is run by TBMC Media and Marketing Solutions Private Limited, trading as The Bengaluru Marketing Company (TBMC), a digital marketing agency in Bengaluru. In this policy, “we”, “us” and “our” mean TBMC.

We are the data fiduciary for the information described here, under India’s Digital Personal Data Protection Act, 2023. That means we decide why and how your information is used, and we are responsible for looking after it.

In short

  • We collect the details you give us when you enquire: usually your name, phone number, email address, city and what you need help with.
  • We use them to reply to your enquiry, understand your requirement and, if you become a client, to run your marketing.
  • We store enquiries in Privyr, our customer relationship management (CRM) tool, so our team can follow up.
  • We do not sell your personal information, and we do not share it with anyone for their own marketing.
  • You can ask us at any time to show, correct or delete what we hold about you.

What information we collect

Information you give us. Depending on how you reach us, this can include:

  • Our website enquiry form: your name, email address, phone or WhatsApp number, company name, website address, the service you need, your monthly marketing budget if you choose to share it, and the message you write.
  • Advertising lead forms: when you respond to our ads on Facebook, Instagram, Google or YouTube, the platform passes us the details you submitted there. This is normally your name, city, phone number and email address.
  • WhatsApp, phone calls and email: your phone number, name and anything else you tell us in the conversation, which we may note down so we can follow up.
  • Job applications: if you apply for a role, the CV and details you email us, including your work history and contact details.
  • Client information: if you hire us, the business details, account access and material we need to deliver the work, along with billing details such as your GST number.

Information collected automatically. When you send an enquiry through our website, we also record the page you sent it from and the campaign details in the web address (utm_source, utm_medium and utm_campaign). This tells us which advertisement or page brought you to us. Your browser keeps those campaign details for the rest of your visit so they can travel with your enquiry; they are cleared when you close the browser.

Our hosting provider also keeps standard server logs, which include your IP address, browser type and the pages requested. These are used to keep the site running and secure, not to identify you.

We do not ask for sensitive information. Please do not send us financial account details, government identity numbers, health information or passwords through the enquiry form or WhatsApp.

Why we use your information

  • To reply to your enquiry, answer questions and arrange a call or meeting.
  • To prepare proposals and quotes for the services you asked about.
  • To provide our services and communicate with you while we work together.
  • To send you follow-up messages by WhatsApp, phone or email about the enquiry you made.
  • To measure which advertisements and pages generate enquiries, so we can spend advertising budgets sensibly.
  • To keep records for accounting, tax and other legal obligations.
  • To consider your application if you apply for a job with us.

We rely on your consent, given when you submit an enquiry or respond to one of our ads. Where the law allows, we also use your information for our legitimate business purposes, such as keeping records and protecting our website. You can withdraw your consent at any time, as explained below.

We will only send you marketing about services other than the one you enquired about if you agree to it, and every such message will offer a way to stop.

Who we share it with

We do not sell your personal information. We share it only with the service providers who help us operate, and only as far as they need it:

  • Privyr — our CRM. Every enquiry is stored there so our team can respond and keep track of the conversation.
  • Vercel — hosts this website and keeps the server logs described above.
  • Cloudinary — delivers the videos shown in our portfolio.
  • Google — the map on our contact page is embedded from Google Maps, so Google receives your IP address when that page loads. We also use Google Ads and Google Analytics to measure our advertising.
  • Meta — runs our Facebook and Instagram advertising, including the lead forms some enquiries come from.
  • WhatsApp — if you message us using the WhatsApp button, that conversation happens on WhatsApp and is covered by their terms as well as this policy.
  • Our professional advisers, such as accountants, and government or law enforcement authorities where we are legally required to disclose information.

Some of these providers store information on servers outside India. When that happens, we only use providers that commit to protecting your information and to using it solely to provide their service to us.

Cookies and tracking

Our website does not set advertising cookies of its own, and it does not use cookies to log you in or remember you between visits. The campaign details described above are kept in your browser’s session storage and are cleared when you close the browser.

We use Google Ads, Google Analytics and Meta advertising tools to understand how our advertising performs. Where these are active on our website, they place cookies or similar identifiers in your browser. These help those companies recognise your device across websites, and may be used to show you our ads again. You can control this:

  • Turn off personalised Google ads at myadcenter.google.com.
  • Adjust your Meta ad settings in the Accounts Centre of your Facebook or Instagram account.
  • Block or delete cookies in your browser settings, though parts of some websites may then not work properly.

Pages that embed Google Maps or play videos may also set cookies belonging to those services.

How long we keep it

We keep enquiry details in our CRM for as long as we may reasonably do business with you, and for up to three years after our last contact, unless you ask us to delete them sooner. Client records, invoices and tax documents are kept for eight years, as Indian tax and company law requires. Job applications are kept for one year in case a suitable role opens up, unless you ask us to remove them.

How we protect it

Our website is served only over an encrypted connection (HTTPS), and enquiries are sent to our CRM from our server rather than from your browser. Access to the CRM is limited to team members who need it, and is protected by individual accounts. No system can be completely secure, but we take reasonable steps to protect your information and to act quickly on any breach, including informing you and the Data Protection Board where the law requires it.

Your rights

Under the Digital Personal Data Protection Act, 2023, you can ask us to:

  • Tell you what personal information we hold about you and what we have done with it.
  • Correct anything that is inaccurate, or complete anything that is missing.
  • Delete what we hold, where we no longer need it for the purpose you gave it or to meet a legal obligation.
  • Nominate someone to exercise these rights on your behalf if you die or become unable to act.
  • Stop sending you marketing messages, at any time.

You can withdraw your consent at any time. Doing so does not affect anything we did before you withdrew it, and we may still keep information the law requires us to keep.

Complaints and grievances

If you are unhappy with how we have handled your information, contact our grievance officer at thebengalurumarketingcompany@gmail.com or +91 96861 05002, with “Privacy complaint” in the subject line. We will acknowledge your complaint and aim to resolve it within 30 days.

If you are not satisfied with our response, you may complain to the Data Protection Board of India.

Children

Our services are meant for businesses, and we do not knowingly collect information about anyone under 18. If you believe a child has given us their details, contact us and we will delete them.

Other websites

Our website and our portfolio link to other websites, such as our clients’ Instagram profiles. We are not responsible for how those websites handle your information, so please read their own privacy policies.

Changes to this policy

We may update this policy as our services or the law change. The date at the top shows when it was last updated, and the current version always lives at this address. If a change materially affects how we use your information, we will tell you.
